BraunHagey & Borden LLP: Supreme Court Declines to Hear Coinbase’s Bid to Block Public Injunction Case, Preserving Californians’ Right to Seek Public Relief in Court

SAN FRANCISCO, Oct. 9, 2025 /PRNewswire/ — On Monday, the U.S. Supreme Court declined to hear Coinbase‘s appeal of the important ruling top litigation boutique BraunHagey & Borden LLP (BHB) obtained in Kramer v. Coinbase, which affirmed the rights of Californians to pursue claims for public injunctive relief in court notwithstanding the defendant’s efforts to force them into arbitration. The case will now proceed in court, where Mr. Kramer seeks an injunction to protect the public from Coinbase‘s claims that its platform is secure—claims that can only fully protect the public if they are litigated publicly before a judge.

By rejecting Coinbase‘s petition, the Supreme Court preserves a critical path for individuals pursuing public-interest litigation to seek remedies outside arbitration that protect the public at large. The ruling reinforces the distinct role of public injunctive relief under California law and ensures that remedies designed to halt ongoing deceptive practices are adjudicated openly, where courts can consider forward-looking relief that benefits all consumers, not just individual claimants.

“We applaud this victory for our client, consumers, and the public,” said Matthew Borden, a partner at BHB and counsel to Mr. Kramer. “Public injunctive relief is a unique remedy that our state courts provide for situations just like this one, which is about a big company misleading the public about the security of its platform. Coinbase is out of delay tactics, and we look forward to having the court decide our client’s claims on the merits.”

BHB represents Mr. Kramer in seeking an order that would require Coinbase to stop misleading statements as alleged about the security of its platform and to implement measures that protect the public and consumers from future harm. With the Supreme Court’s denial, the parties return to litigate the claims transparently in California state court.
